This agreement is made and entered into this __ day of ____2007, by and between
Joseph and Marilyn McMullin hereafter called the seller and/or breeder and ____________________________hereafter
called the buyer and/or lessor
Whereas, seller agrees to sell and hereby does sell and on this date deliver
to buyer the following Dog/ Bitch
Said dog is said to be free of any communicable diseases, up to and including
the date of this agreement. Buyer has paid the sum of $_______ and receipt hereof
is hereby acknowledged.
1. The above mentioned animal is sold to the buyer as a pet only and as such
shall not be used for breeding purposes, pursuant to the Canadian Kennel Club.
2. The breeder will guarantee the puppy for two years against genetic diseases
such as PLE/PLN or hip displasia.
3. The buyer acknowledges that the animal has been received by him/her in good
condition and your puppy must be examined by a licensed Veterinarian. Should
he find a physical problem which would constitute your puppy to be a poor health
risk, the puppy must be returned to the seller within 2 weeks of the examination
with the Veterinarian written documentation of any problem then the seller will
provide you with a full refund of the original purchase of the puppy. The seller
will not be liable for any veterinary expenses or related charges of any kind
what so ever without the specific prior written authorization of the seller
JOMAC Red'd Kennels, Joseph H. McMullin.
4. The seller will not in any case be liable for any amount exceeding the purchase
price of the puppy.
5. Any conditions caused by the administration of the vaccines or other wise
environmentally induced are not covered under this agreement.
6. The buyer agrees to take good and reasonable car of the above-mentioned animal,
to feed and house the animal properly and to promptly give or secure attention
to the health and welfare of the animal at his/her own expense. It is also understood
that the seller shall be notified before any disposal of the animal is made
and given first option to take the animal back. Resale of this animal to any
pet wholesaler or pet shop or anyone connected therewith is strictly prohibited.
If the animal is placed with a new owner, the new owner must agree in writing
to be bound by the provisions of this agreement and any and all resale documents
shall be prepared in accordance with the seller's requirements at the buyer's
expense.
7. The animal shall be spayed/castrated on or before the age of one year and
the buyer shall supply the seller with a licensed Veterinarian's Certificate
which clearly identifies the animal and confirms that the surgery has been successfully
performed. It is agreed and understood that the animal shall be individually
registered with the Canadian Kennel Club and the seller shall retain the Certified
Registration until the aforementioned Veterinarians certificate is received.
8. After the first week the guarantee is a replacement puppy only.
9. The parties hereto mutually agree to the following terms as of this day and
year first above written.
